Lessons from Beatriz: El Salvador & the Denial of Life-Saving Abortions Worldwide

“I don’t want to die,” Beatriz said.[1]

Beatriz is a 22-year-old Salvadoran woman who was recently denied the right to an abortion during her high-risk and potentially fatal pregnancy. Her court case has captured international attention, bringing to light the staunch anti-abortion policies of El Salvador and in other areas of Latin America, and around the world, even in life-threatening circumstances.

Beatriz suffers from lupus and other medical complications which worsened during her first pregnancy. Her doctors at the National Maternity Hospital claimed that with the progression of the 26-week pregnancy, Beatriz’s risk of hemorrhaging, kidney failure and maternal death would increase exponentially. Additionally, the fetus had a birth defect called anencephaly, in which a baby develops without parts of its brain and faces very little chance of survival. As a result, Beatriz sought an abortion for the sake of her health and the well-being of her young child at home that she must care for. The Government of El Salvador denied her an abortion despite her, her doctors’, and the international community’s entreaties. On May 29, El Salvador’s Supreme Court upheld the Government’s decision to deny her an abortion, based upon its reading of the country’s abortion ban, which was an “absolute impediment to authorize the practice of abortion.” The court claimed that “the rights of the mother cannot be privileged over those” of the fetus.[2]

After the Supreme Court’s ruling, the Inter-American Court of Human Rights (IACHR) promptly responded and demanded that the government “immediately adopt the necessary measures to protect the life, personal integrity and health” of Beatriz.[3] In addition, the IACHR held that “the Salvadoran State is obligated to ‘guarantee that the treating medical team has the … protection to fully exercise its function according to the decisions that, based on medical science, said medical team should adopt.’”[4] Such protection of medical personnel—granting them the freedom to make decisions based solely upon medical ethics rather than political considerations—guarantees better outcomes for female patients facing dangerous pregnancies, as it permits medical personnel to prioritize the patient’s welfare above all else. This mandate is also found under international humanitarian law, to protect doctors who provide life-saving abortions in humanitarian settings from prosecution under local criminal abortion laws.

On May 30, El Salvador’s Ministry of Health overrode the Supreme Court’s decision. María Isabel Rodríguez, the Salvadoran Minister of Health, announced that Beatriz would be allowed to end her pregnancy “at the first sign of danger” through an induced birth.[3] As a result, on June 3, Beatriz underwent a Cesarean section. Her daughter was born without a brain, and died five hours later.[5]While the decision of the Ministry of Health should be applauded for having saved the life of one woman, it does not do the necessary work of challenging El Salvador’s strict ban on abortion. The law must be changed so that other Salvadoran girls and women with dangerous pregnancies are not forced into the same suffering, uncertainty, and risk of death as Beatriz faced.

While many countries in Latin America, like Uruguay, Mexico City, Colombia, Brazil and Argentina have relaxed their highly conservative abortion laws, other nations including Chile and Nicaragua continue to maintain misogynistic and repressive restrictions on women’s reproductive rights.[6]Beatriz is one example of thousands of women across Latin America – and the world – who are denied access to safe abortions, even in cases of high risk pregnancies or pregnancies resulting from rape.

Shockingly, the United States, too, perpetuates this inhuman policy, by denying access to safe abortions for girls and women raped in war. This violates the Geneva Conventions and international humanitarian law (IHL).

Here’s how this US policy violates the Geneva Conventions: The 1973 Helms Amendment places a blanket abortion ban on all US humanitarian aid, even for girls and women who are brutally raped as a weapon of war, and those who face potentially fatal health risks.

The Global Justice Center sent a petition, and has organized a letter-writing campaign, to President Obama and continues to take action to ensure girls and women are guaranteed the nondiscriminatory medical care that is their absolute right under IHL. Bans on abortion maintain a society in which women and girls possess rights to health and life that are less than those of men and boys. It is clear that, as one of Beatriz’s lawyers, Victor Hugo Mata, said: “Justice here does not respect the rights of women.”[2] Action must be taken to change these oppressive policies in El Salvador, the United States and around the world.

Letter to President Obama: United States Restrictions on Abortion Access Violates International Humanitarian Law

Louise Doswald-Beck, the former Head of the International Committee of the Red Cross' Legal Division (ICRC), former Director of the University Centre for International Humanitarian Law (CUDIH) and former Secretary General of the International Commission of Jurists wrote to President Obama on how the US abortion prohibition attached to humanitarian aid violates the rights of women and girls raped in armed conflict under IHL, and is a form of torture.

European Parliament Members Ask President Obama to End Inhumane Abortion Ban on Aid to War Rape Victims

On March 7, 2013, the European Parliament issued an open letter to President Obama, urging him to lift US abortion restrictions on aid to war rape victims.

The Global Justice Center's August 12th Campaign challenges the denial of life-saving abortions to girls and women who are raped and impregnated in armed conflict, as a violation of the Geneva Conventions.

This letter highlights the fact that the US "no abortion" clause negatively affects how aid from foreign governments can be administered because it is often pooled together. As a result, humanitarian aid organizations on the ground are often unable to provide medically-necessary abortions to girls and women who have endured the horrors of war rape.

MEPs urge Obama to rescind US abortion ban for women raped in armed conflict

In an open letter to United States President Barack Obama, Members of the European Parliament Working Group on Reproductive Health, HIV/AIDS and Development (EPWG) urge the head of state to immediately lift US abortion restrictions on humanitarian aid for girls and women raped and impregnated in armed conflict. "Withholding war raped women the right to safe abortion as a result of US development aid policy is a form of violence against women and girls, priority theme at the UN Commission on the Status of Women in New York", says Chair of the EPWG, Dutch Liberal Democrat Sophie in 't Veld.

In 't Veld and colleagues have been campaigning for the EU and its Member States to no longer accept the US imposed ban. "Europe must speak up for those women, and urge our American friends and allies to immediately abolish the ban."

The US imposes a "no abortion" clause on its foreign aid, which in practice means that humanitarian organizations that receive US funding neither talk about nor provide safe abortions to victims of war rape. In 't Veld comments: "Rape is being used as a weapon of war, destroying lives, families and communities. Women victims are already punished enough and should not be denied the right to a safe termination of the resulting unwanted pregnancy."

Every year, tens of thousands of girls and women are raped during armed conflicts. More than two-thirds of conflict-related rape in the Democratic Republic of Congo (DRC) are gang rapes, one third of the victims are girls under the age of 18. Given that many girls and women in the DRC are raped in the context of sexual slavery, they incur the greatest risk of pregnancy. In 't Veld: "The fact that United States is the world’s largest provider of humanitarian aid has enabled it to impose its policy on abortion on neutral organizations, such as the International Committee of the Red Cross. The US should make a distinction between abortion as a means of family planning and termination of pregnancy as a medical necessity."

CSW 57: Commission on the Status of Women

The Commission on the Status of Women is being held at the UN during these next two weeks, and GJC will be in attendance as a consultative member of the NGO working group on women, peace, and security. Janet Benshoof, GJC president, will be speaking on two panels to highlight the importance of ending violence against women in conflict.

The Global Justice Center is working diligently to advocate for gender inequality in conflict and post conflict situations. Our August 12th Campaign is challenging the routine denial of medical rights to war rape victims as a violation of the right to non-discriminatory medical care under the Geneva Conventions. Thousands of girls and women raped in armed conflict are routinely denied their rightful access to safe abortions, and we must put a stop to this. Furthermore, girls and women are raped daily to accomplish military objectives, including genocide. Rape is more effective and cost effective than any other unlawful weapon used in armed conflict today, yet it is routinely overlooked by the international community. GJC’s Rape as a Weapon of War project is working to ensure that states using this method of warfare are held accountable for their actions.

Stephanie Johanssen, legal counsel for European and UN affairs at GJC, has been working tirelessly on behalf of GJC as a member of the working group on women, peace, and security to monitor implementation of Security Council resolutions on the role and rights of women in conflict situations. GJC uses its consultative status with the United Nations to be a leading voice urging UN bodies to fulfill their obligations to act against fundamental law violations. The UN is the epicenter of global efforts to end impunity for perpetrators of war crimes, and gives GJC the ideal access point to strengthen the impact of our legal arguments.

CSW 57: The Gap between Image and Reality

The 57th session of the Commission of the Status of Women (CSW) is over and the agreed conclusions have been adopted. Some delegations made reservations but did not block the adoption of the final draft. Every year, the CSW session also serves as a forum for UN member states to do a bit of PR for themselves. Words like “committed,” “dedicated,” “acknowledge,” and “affirm” are heard often and most countries have an interest to show the world how they are leaders when it comes to furthering women’s rights. However, all too often, these statements stand in stark contrast with a country’s foreign policy. The United States is one example.

In explaining the US position on the Agreed Conclusions of this year’s CSW, U.S. Deputy Representative to ECOSOC Terri Robl, said in a statement on March 15: “Reproductive rights and the full implementation of these international agreements are essential to the prevention, mitigation and elimination of violence against women and girls. The United States reaffirms our continuing commitment to protect and promote reproductive rights.” If the United States is committed to protect and protect women’s reproductive rights why not lament the Agreed Conclusion’s weak reference concerning the right to safe abortion access which was limited to national laws?

Because reality looks very different:

USAID administrative policy, formally adopted in 2008, contains no exception for abortions for rape or to save the life of the rape victim, and is, at least on paper, more restrictive than federal statutory requirements (including the Helms Amendment to the Foreign Assistance Act, which first placed abortion restrictions on foreign aid in 1973).

As the largest provider of humanitarian aid in the world and by funding most major humanitarian actors, the US is able to dominate the field of humanitarian aid with its no abortion policy and is responsible in large part for the global failure to provide the option of abortion to victims of war rape. Many have joined with the Global Justice Center to challenge this inhumane US policy as a violation of the rights of girls and women to non-discriminatory medical care under the Geneva Conventions.

CSW may be over, but the time is now for the US to live up to its rhetoric.

Global Day of Action: Help GJC fight for safe abortion access for girls & women raped in war

For over two decades, women’s rights organizations in Latin America have mobilized around September 28th, which is also the day slavery was abolished in Brazil. Today, the Global Justice Center joins the Women’s Global Network for Reproduction Rights, who have declared September 28th Global Day of Action for Access to Safe and Legal Abortion. As part of our August 12thCampaign, GJC fights for full medical rights for girls and women raped in war, including access to safe abortions. We urge President Obama to lift the blanket abortion on US humanitarian aid that denies a girl or woman raped in war the option of an abortion, even in life/threatening situations.

War rape victims are forced to carry the child of their rapists in conflict areas such as Burma, the Democratic Republic of Congo or the Sudan, where systematic rape is often used as a weapon of war. It is even used to accomplish military goals such as genocide and ethnic cleansing. Apart from being inhumane, the American ban also violates the Geneva Conventions, which guarantee non-discriminatory medical care to the “wounded and sick”. Todd Akin Redux! – Rep. Rick Berg Supports Prison for Rape Victims Choosing Abortion

Hot on the heels of Rep. Todd Akin’s “legitimate rape” firestorm, yet another senatorial candidate has taken an extreme and inhumane stance on a rape victim’s right to choose. In 2007, Rep. Berg (R-ND) voted in favor of a bill that would criminalize abortion, even in cases of rape. The North Dakota penal code knows four categories of felony, ranging from AA to C with AA carrying the severest punishment of a life sentence. It is telling that the bill Berg voted for lists abortion as Class AA “crime”. Horrifically enough, sexual crime classifies as category B offense. In essence, the bill results is a penal system that punishes the victim and not the perpetrator.

The bill was never signed into law, and even if it were, the Supreme Court would have struck it down as unconstitutional. Yet, while Republicans and Democrats have both distanced themselves from these views calling them extreme in domestic policy, punishing war rape victims is mainstream in American foreign policy.

Last year the Global Justice Center launched our “August 12th” campaign, and we continue leading the charge to urge President Obama to issue an executive order lifting the abortion ban on US humanitarian aid, a policy that “twice tortures” war rape victims by denying them their full medical rights, including access to safe abortion services. Consistent with Rep. Berg’s views, USAID’s policy bars recipients of American aid from providing critical services and information about safe abortion options to girls and women in conflict zones impregnated through rape—even in life-threatening cases. These recipients include NGOs and other humanitarian agencies working on the ground in conflict areas such as Burma, Congo or the Sudan, where rape is systematically used as a weapon of war. Current US policy hinders these organizations in helping rape victims. The Atlantic recently published a GJC article about this critical issue. The 1973 Helms Amendment, which is cited as the legal background for USAID’s policy, only prohibits the funding of abortion as a means of family planning—it should not be interpreted as applying to cases of rape or where a woman’s life is in danger. In fact, the current interpretation undisputedly violates international humanitarian law and the Geneva Conventions. It is time to change this.

In wake of the Akin scandal, President Obama emphasized a women’s right to make her own health choices. It is now time for the President to take action and issue an executive order lifting the ban. Restore full medical rights to these girls and women who have suffered the horrors of rape and war.

DNC: Rhetoric vs. Action

From the Wall Street Journal to CNN, everybody feels Democrats at the DNC have been relentless about women’s right to make their own choices. According to Michelle Obama, the president believes women “are more than capable of making our own choices about our bodies”. In the words of Nancy Pelosi, a vote for President Obama is “a vote for women’s rights”. Deval Patrick would keep the government out of a woman’s decision whether to keep an unwanted pregnancy. Obama himself says Washingtion politicians “should not control women’s health care choices”.

Why then does America’s government, through the the policies of USAID, deny the right to an abortion for girls and women systematically raped in conflict areas like the Congo, Burma and the Sudan? Join the GJC’s August 12 campaign and urge president Obama to lift the abortion ban.

Rep. Roscoe Bartlett Supports False Claim of Nearly Nonexistent Pregnancy Rates Resulting From Rape

Once again, we are left speechless by the extreme rhetoric used to describe rape victims. Rep. Roscoe Bartlett (R-MD) added vitriolic fuel to the controversy sparked by Rep. Todd Akin’s comments regarding pregnancy rates resulting from “legitimate rape.” In addition to the offensive attempt to distinguish acts of rape – rape is rape; their claim of nearly nonexistent pregnancy rates resulting from rape is scientifically entirely false.

One would imagine that since Akin’s comments gained international scorn, politicians would be more prudent and rational when discussing the topic of abortion. The lesson to be learned clearly went amiss for Rep. Bartlett who, in a similar comment to Akins’ said, “There are very few pregnancies as a result of rape, fortunately, and incest — compared to the usual abortion, what is the percentage of abortions for rape? It is tiny. It is a tiny, tiny percentage.” The remark, was made at a town hall meeting when pressed to reiterate his stance on abortion. And while he recently modified his stance to include exceptions of life threatening situations, rape, and incest, his comment reflects an ignorance about the horrors of rape and its devastating consequences.

Yet despite immediate condemnation, the fact is US foreign policy does not stray far from Bartlett and Akin’s beliefs. The US currently places a blanket ban on abortion aid, denying abortion options to girls and women raped in war. According to the 1973 Helms Amendment, “no foreign assistance funds may be used to pay for the performance of abortion as a method of family planning.” USAID wrongly interprets this statement to include circumstances of rape. This inhumane policy does not even allow for abortion in the case of life-threatening circumstances. For women and girls in nations such as Burma, Sudan, and Congo where systematic rape is used widely as a weapon of war, this ban on abortion “twice tortures” them. Furthermore, this policy is in direct conflict with international law and the Geneva Conventions, which guarantee indiscriminate medical care for victims of rape. As America continues its national discussion of abortion laws, it is critical that we do not forget those suffering abroad from the horrors of rape and war. President Obama must seize this moment to act. Join the Global Justice Center in urging him to issue an executive order lifting the ban. It is a necessary step to help victims of rape in conflict areas and to show solidarity with rape victims everywhere.

Think Republican Senate candidate Todd Akin’s remarks on “legitimate rape” went too far?

So do we. In fact, so does the Obama administration and the Romney campaign, both of whom were quick to condemn Rep. Akin’s ill-advised remarks that women who are “legitimately” raped rarely get pregnant.

Akin’s statements are particularly shocking as they ignore the fact that rape is routinely used as a weapon of war in areas of armed conflict, particularly in areas of ethnic conflicts as a way to redefine ethnic composition, as in Darfur or Rwanda.

Yet, despite both Presidential candidates proclaiming Akin’s remarks as unacceptable, the fact is the United States currently hinders access to safe abortions for thousands of girls and women raped in armed conflict every day.

The United States Agency for International Development (USAID), which administers US humanitarian aid, puts a “no abortion clause” on every contract with NGOs, international organizations or even governments, preventing rightful access to safe abortion services for women – even in cases of rape or when the women’s life is in danger.

USAID’s position on this is clear and provides that “while USAID supports treatment for abortion-related complications, USAID does not support abortion as a means of family planning nor does USAID provide abortions in any circumstances.”

For this reason the Global Justice Center (GJC) launched the “August 12th” campaign last year – in commemoration of the anniversary of the Geneva Conventions. Under the Geneva Conventions girls and women raped in armed conflict are “protected persons” and entitled, as the “wounded and sick,” to “receive to the fullest extent practicable and with the least possible delay,the medical care and attention required by their condition.”

Therefore the US “no abortion” clause not only exacerbates the suffering of rape victims in war, it violates the rights of these victims under international humanitarian law.

On November 5, 2010 during the Universal Periodic Review of the United States by the UN Human Rights Council, Norway recommended that the US “remove its blanket abortion restrictions on humanitarian aid covering medical care given to women and girls raped and impregnated in situations of armed conflict.”

Since the launch of GJC’s “August 12th” campaign, more than 60 international organizations have written urgent letters to President Obama calling on him to lift the abortion restrictions. Among them are Amnesty International U.S.A., the New York City Bar Association, the Paris Bar Association, the Egyptian Center for Women’s Rights, Physicians for Human Rights, and the American Medical Women’s Association.

Most recently added to the call to lift the ban is a powerful letter from Women’s Synergie for Victims of Sexual Violence co-founder Justine Masika Bihamba, who works in the conflict area of Eastern Congo. To read Justine’s letter, click here. President Obama now has support from all over the world to lift these restrictions via an executive order.  

In wake of the response to Rep. Akin’s remarks from both Democrats and Republicans alike, the US must now support its words through actions. It is time for President Obama to issue an executive order lifting the abortion ban and ensure that girls and women raped in war are also allowed to make their own health care decisions. A girl or woman impregnated by rape should not be forced to bear the child of her rapist – whether it is in the United States or in armed conflict zones around the world.

Disappointment at Rio+20 for Women

The outcome of the Rio+20 summit failed women everywhere. Language regarding reproductive rights and gender equality was dropped from the draft agreement, representing a significant step backwards from earlier agreements.

Going into the summit, the draft document included specific language ensuring reproductive rights and gender equality. A handful of oppressive regimes opposed this language and the Holy See led the opposition in an influential campaign that insisted on equating women’s reproductive rights with abortion. In reality, reproductive rights are about a great deal more than abortion, but unfortunately, the Holy See was able to assert enough pressure to succeed in getting the language removed from the agreement, leaving behind only vague references to reproductive health.

Ironically, most states are already under obligation to ensure reproductive rights and gender equality. As of today, 187 states have ratified Convention on the Elimination on the Elimination of All Forms of Discrimination Against Women (CEDAW), which requires member states to, among other things, take affirmative action to eliminate gender discrimination and to ensure that women have access to affordable, quality health services, including reproductive health. In fact, lack of access to reproductive health services and information is considered discriminatory against women under CEDAW. Unfortunately, due to weak enforcement mechanisms and a substantial number of reservations taken by states in ratifying the convention, performance of state obligations under CEDAW has been relatively poor. Including strong reproductive rights and gender equality commitments in the Rio+20 agreement would have been an excellent way to reinforce the importance of these issues, especially since it would have been from a sustainable development perspective.

Every day, evidence of the importance of reproductive rights and gender equality can be found in the news. For instance, Save the Children just came out with a  report on family planning finding that complications during pregnancy is the number one killer of teenage girls worldwide; babies born to mothers under the age of 18 are 60% more likely to die before their first birthday; and a “major barrier to family planning is that many vulnerable women and girls are unable to exercise their rights to make decisions over their own health care, including family planning.” Additionally, in Uganda, where approximately 16 women die during childbirth every day, women activists are currently taking a case to the Supreme Court in an effort to force the government to provide better maternal health care.

Rio+20 represents a lost opportunity. What could have been a significant step forward for women’s rights turned into yet another instance where women were left out of the picture.

Children of War

The conversation about the importance of providing abortion services to victims of rape in armed conflicts would be incomplete without looking at the impact on children born to rape victims. The international community has already recognized forced pregnancy as a crime under the Rome Statute of the International Criminal Court (ICC) but it has a limited application since it requires all three elements of the crime to be satisfied. Article 7, paragraph 2 (f) requires–(1) unlawful confinement of a woman (2) forcibly made pregnant (3) with the intent of carrying out other grave violations of the international law. It is unclear what exactly falls under other grave violations of international law and means that women who were forcibly made pregnant but escaped or forcibly made pregnant without the requisite intent are not protected under the Statute.

As a result of rape or forced impregnation, these unwanted children whose mothers were forced to carry them to term due to lack of abortion services are often subject to stigma, discrimination, abandonment, abuse, neglect, and even infanticide, especially in cases of boys who are seen as potential enemy combatants. These children are commonly rejected not only by their mothers who seek to avoid shame but also by the entire community- they are seen as illegitimate, “enemy” children and may be denied citizenship rights, effectively rendering them stateless. In Rwanda, children born out of rape are often referred to as “children of hate” or “children of bad memories.”Lacking necessary support from their mothers and communities, rape children are caught up in a vicious cycle and end up getting exploited, becoming child soldiers or turning to prostitution and crime. They are more likely to suffer psychological and physical trauma as a result of unsuccessful abortion attempts by their mothers or nonexistent neonatal care, and are at a higher risk to contract HIV. They also often have attachment and trust issues even later in life and are unable to maintain familial relationships. Even children who are kept by their mothers are often raised in extreme poverty resulting from societal stigma that prevents rape victims from finding a job given lack family support or alternative childcare options.

Currently there are no specific initiatives by the international community that would protect and provide assistance to rape babies. The ICRC, WHO, and UNFPA merely issued recommendations recognizing the need to combat stigma associated with rape children. Readily available access to safe abortion services could provide an immediate solution for rape victims who are now forced to carry to term an unwanted pregnancy and later abandon or even murder their unwanted children.

Syria to reconsider its abortion law

Recently a Saudi cleric Sheikh Ali al-Maliki expressed an opinion that Syrian women raped by gang-like militia or forces loyal to President Bashar al-Assad should be allowed to undergo abortion.  He described rape as one of the most heinous crimes against women that is worse than murder.

Current Syrian law only allows abortion to save woman’s life making abortion in all other circumstances including illegal.  Penalty for performing an abortion with woman’s consent is one to three years imprisonment, and penalty for a woman who consented to abortion is six months to three years imprisonment but can be reduced if abortion is done to save woman’s honor. Syria is officially a secular state with the vast majority of its population practicing Islam but its abortion restrictions are harsh even for the Islamic world.  Schools of Muslim law universally accept that abortion is permitted if continuing the pregnancy would put the mother’s life in danger even if the pregnancy is over 120 days old but variation of thought exists when it comes to other exceptions to the abortion ban. Tunisia and Turkey have significantly liberalized their abortion law and allow it under virtually all circumstances within the first trimester, although a recent bill pending in Turkey could effectively outlaw abortion. Jordan, Kuwait, Morocco, Qatar, and Saudi Arabia allow abortion in cases of serious health risk. Iran, Kuwait, and Qatar created an exception in cases of fetal defects assuming the pregnancy is less than 120 days old. Sudan, Egypt, Bosnia, Algeria, and Bangladesh make abortion permissible in circumstances of rape or incest. Examples of the above mentioned interpretations show that Islamic law can be flexible when it comes to women’s reproductive rights. Pending decision of the Council of Senior Muslim Scholars, Syrian women might soon also be able to legally abort fetuses conceived as a result of war rape.

The US Leads in ICRC Aid Donations, but Restricts Equal Rights for Aid Recipients

The United States strives to be a leader among the nations in terms of equality and fairness.  However, one area that starkly contrasts that desire is the US policy regarding how to use the funds it donates to humanitarian aid.  The United States is the largest contributor of humanitarian aid to the ICRC.  Along with its donation of over 240 million Swiss Francs, the US has instructed that its aid may not be used to fund abortions under any circumstances.

As the largest donor of aid to the ICRC, the US retains a great deal of control over how that money is spent.  In addition to holding the power to restrict how its own contributions are spent, the US’s power extends further in some instances to determine how donations from other sources may be restricted as well.  If the ICRC is funding an initiative with money that comes from the US as well as other governments whose funds may contain no restrictions, the entire initiative will be subjected to the restrictions that the US has placed on its donations.

Women who have been raped in armed conflict have been recognized as under the category of “wounded, sick, and shipwrecked” under the Geneva Conventions Additional Protocols, and that affords them the right to receive medical care to the greatest extent practicable, including abortions.  Without the ability to receive safe, legal abortions, pregnant war rape victims will be forced to endure great psychological and physical pain and in many cases resort to clandestine abortions or even suicide.

The repercussions that result from failure to provide abortions to war rape victims are enormously detrimental and the practice is blatantly discriminatory against women.  Many organizations and countries, notably the Paris Bar and the German Women Lawyers’ Association, have supported the efforts to try to get the US to change its policies and lift the ban on abortions for its international aid.  Most recently, the Egyptian Center for Women’s Rights (ECWR) has written to President Obama asking him to lift the restrictions through executive order.  ECWR, being the first Middle Eastern organization to support these efforts, is setting the tone for the rest of the international community as well as the United States itself, and that tone is one of equality and intolerance of discrimination.

In its letter to President Obama, ECWR points out the hypocrisy of the United States.  The US consistently demands that Middle Eastern countries end discrimination against women and advocate for women’s equality, yet they fail to follow through with the same position that they advocate by maintaining these discriminatory restrictions.  It is time for the US to put an end to its double standard and to institute the same policies domestically that it promotes for states.  The US is the example that other countries strive to emulate.  With restrictions that so blatantly discriminate against women, the US as an example leaves much to be desired and must rectify this injustice immediately, and truly demonstrate to the international community what is right.

Contradictions and Empty Guestures – USAID’s New Policy on Gender Equality

According to the United States Agency of International Development’s new Gender Equality and Female Empowerment Policy, “Gender equality and female empowerment are …fundamental for the realization of human rights.” This policy directing USAID aims to: Reduce gender disparities in access to resources and opportunities, reduce gender-based violence and mitigate its harmful effects on individuals and communities and increase capabilities of women and girls to realize their rights, determine their life outcomes. Certainly these are lofty and noble goals. Yet, is USAID making an empty gesture?

The tactical and deliberate use of rape as a weapon of war has been reported in at least 36 recent conflicts. Often, rape is used as an effective tool to terrorize and destroy communities, leaving women and girls with significant and sometimes deadly, physical, psychological and social consequences. Following the horrific wake of the Rwandan Genocide, the International Criminal Tribunal for Rwanda (ICTR) found that rape can be a war crime, crime against humanity and constitutive act of genocide.

Yet, for the victims of these heinous crimes, the chance of having a full and healthy life is often denied. Even if women impregnated by rape survive the high risks of maternal mortality, they often suffer further ostracisation from their community. Facing these harmful outcomes, women are denied the option of abortions – perpetuating their suffering and trauma.

USAID, while paying much lip-service to its gender-egalitarian vision, hardly mentions sexual violence against women in its policy. As one of its policy goals, USAID aims to reduce gender-based violence and mitigate its harmful effects. In light of the suffering of impregnated women through rape, isn’t the most effective means in mitigating the harmful effects to provide safe abortions?

However, currently under the Helms Amendment and other related abortion restrictions on foreign assistance, prohibits the use of U.S. foreign assistance funding to motivate or provide abortions. This prohibits all non-governmental organizations (NGOs), governments and humanitarian aid providers from using U.S. funds to “motivate” or provide abortions. The restrictions, placed in allforeign assistance contracts, contain no exceptions for rape or to save the life of a woman and affects the provision of services, as well as censors all abortion speech. Thus far from alleviating and mitigating the harmful effects of sexual violence, the prohibition actually perpetuates further suffering for the victims.

Additionally, the current restrictions violates the rights afforded to the “wounded and sick” persons, who are entitled to non-discriminatory and comprehensive medical care as envisioned under common Article 3 of the Geneva Conventions and the legally-binding principles of customary international law. The prohibition has the effect of systematically denying girls and women in armed conflicts the right to complete and comprehensive medical care. How can women realize the fundamental human rights when current USAID restrictions deny them?

Although the USAID’s new policy highlights the importance of gender equality, it fails to meaningfully alleviate the harmful consequences of sexual violence. Behind the talk of gender equality and women empowerment lays a deep contradiction. While promising women relief and the realization of their human rights, USAID restrictions do the opposite. If women are to truly enjoy the ideals set out in USAID’s new policy paper, the Helms Amendment needs to be revoked.

The London Times published an article feauturing the Queen’s Counsel’s effort to pressure President Barack Obama to issue an Executive Order lifting the “no abortion” clause that affects U.S humanitarian aid for girls and women involved in conflict.

This movement was inspired by the launching of the Global Justice Center’s “August 12th” campaign which urges President Obama to reinstate U.S support for the Geneva Conventions by removing the blanket abortion prohibitions embedded in U.S humanitarian aid that endanger women and girls who have been raped and impregnated in armed conflict. The Perils of the Inaccessibility to Reproductive Healthcare in Eastern Burma

A woman should never have to resort to using a fishing hook or dangerous medications as the only feasible options to terminating a pregnancy. Yet these dangerous tactics remain pandemic in eastern Burma where inaccessibility to proper healthcare and safe abortions threatens the livelihood of thousands of women. A recent report by Ibis Reproductive Health highlights the dire state that women on the Thai-Burma border are in. The fact that so many women in Burma turn to these fatal and unsafe method of pregnancy termination underscore the need for safe abortions.

Yet, despite this clear need, USAID silences any prospects for these women to enjoy a healthier future. The United States, being the largest donor of humanitarian aid, has an immense amount of influence on how aid is distributed. When Congress implemented the Helms Amendment in 1973, abortion restrictions were placed on foreign aid. Under “Helms” no USAID funding may be used to pay for abortion as a method of family planning. The amendment contains a provision that prohibits abortion speech, saying that the funds cannot be used to “motivate or coerce any person to practice abortions.” The Global Justice Center staunchly argues that these abortion restrictions are a violation of the rights of girls and women raped in armed conflict under international humanitarian law. This is because the Geneva Conventions recognize that women and girls raped in armed conflict, as “protected persons”, are classified as “wounded and sick” and are entitled to “receive to the fullest extent practicable and with the least possible delay, the medical care and attention required by their condition.” Therefore, depriving these girls and women of this care is unlawful and this injustice is the driving force behind the Global Justice Center’s August 12th campaign.

Focusing in on eastern Burmese women, it is clear that they do not have a credible institution to turn to when it comes to reproductive healthcare. In fact, reproductive healthcare in Burma is known to be the worst in the world.  The “Separated by Borders” report, released by Ibis Reproductive Health and the Global Health Access program exposes the crippling healthcare infrastructure in eastern Burma.  The GJC has long noted the terrible state of eastern Burmese women when it comes to accessibility to reproductive health care and abortion, especially during conflict. The Global Justice Center is using legal tools to work diligently to help lift the “no abortion” clause in U.S humanitarian aid to make this type of care more accessible so women in order to prevent prolonged suffering.

Based on the Ibis Reproductive Health Report, RH Reality Check author Anna Clark notes the life-threatening repercussions of depriving Burmese women of reproductive services including unwanted pregnancies, unsafe abortions and death. Furthermore, 80 percent of women in eastern Burma have never used birth control due to the overall inaccessibility of contraceptives and the lack of legitimate healthcare.

Granting women in eastern Burma their rights, including access to reproductive healthcare will be a step in the right direction for Burma. Burmese women will not only be alleviated from suffering, but, they will also have the opportunity to become more active members of society. Utilizing the rule of law, the Global Justice Center works to dismantle the patriarchal structures inhibiting women’s rights to make sure that the prioritization of women’s health will be factored into the equation in the years to come.

The August 12th Campaign: Urge President Obama to Rescind the Abortion Restrictions Placed on All Us Humanitarian Aid for Girls and Women Raped in Armed Conflict

[NEW YORK, NY]- August 12, 2011 will mark the 62nd anniversary of the adoption of the Geneva Convention of 1949. This cornerstone of International Humanitarian Law (“IHL”) extends to “wounded and sick” civilians the right to comprehensive and non-discriminatory medical care during armed conflict. Yet today one group of civilian victims – namely girls and women impregnated through rape during armed conflict – is routinely denied complete medical care in international humanitarian settings. Specifically, these victims are denied the option of abortion in violation of their rights under the Geneva Conventions and IHL.

Global Justice Center and Other Women's Health Advocates Call for the Obama Administration to Make the US a Leader in Pushing for Reproductive Rights Worldwide in Conscience Magazine

Women's health advocates are disillusioned with the lack of effort the Obama Administration has made in addressing reproductive rights for women around the world. Michelle Goldberg details the work of these advocates and the frustration they are experiencing with the Administration in a recent article published in Conscience Magazine. Since 1973, with the passage of the Helms and later Siljander Amendments, prohibitive US policies have prevented access to reproductive healthcare for women around the globe. Fortunately, the GJC sees a new and unique opportunity for the current Administration to overturn the policies that prohibit access to abortion for girls and women raped in armed conflict.

Both the Helms and Siljander Amendments leave room for interpretation, and as Goldberg notes, "American aid programs needn't interpret [those Amendments] as narrowly as they do." Barbara Crane, Vice President of Ipas points out that a precedent does exists for exceptions in the cases of rape, incest and to save a woman's life. Until now, the US has refused to provide abortion care, even for women and girls impregnated as a result of rape. As enumerated by the Global Justice Center in a legal brief released earlier this year, it is a violation of the rights of girls and women in conflict to deprive them of adequate medical services under the Geneva Conventions. These detrimental US restrictions must be overturned as they further victimize those most in need of protection and complete healthcare; girls and women raped and impregnated in armed conflict.

The international reproductive community had high hopes when the President decided to overturn the Global Gag Rule three days into office; however it only removed restrictions placed on foreign NGOs receiving US funding from engaging in any abortion related activities using their own private funds. Real impact can be made by repealing the Helms Amendment, which will remove censorship on the $49 billion dollars in foreign aid distributed by the US. While many feel as though the chance has been lost, especially with Republican control of the House, and recent attempts to drastically reduce funding for family planning, an executive order would immediately ensure that US funds provide care to the women and girls that need it the most.
