Security Council Member States' Legal Obligations for ICC Referral

All of the Security Council member states possess certain international legal obligations to act on the situation in Burma, as determined by being states parties to an array of international treaties and conventions on human rights. The inaction of the Security Council is a failure of the member states to fulfill their international legal obligations based on the international treaties and conventions.
